Reporting a Marine Incident
Vessel operators are required by law to submit a report in the event of a marine incident. Under the Transport Operations Act 1994 a marine incident is one that causes or involves:
the loss of a person from a vessel, bodily harm or death caused by a vessel’s operation, the loss or abandonment of a vessel, a collision with a vessel, the running aground of a vessel, material damage to a vessel, material damage caused by a vessel’s operations, danger to a person, danger or serious damage to a vessel, danger or serious damage to a structure.
A marine incident must be reported within 48 hours to Queensland Water Police, Queensland Boating & Fisheries Patrol Officers or Shipping Inspectors at Maritime Safety Queensland.
Reports are to be made on the approved form, which can be obtained from Queensland Transport Customer Service Centres. A selection of Incident reports from each year can be viewed on the Maritime Safety Queensland home page,( www.msq.qld.gov.au ) look under “Features” and click on “Incident Safety Reports”‘. Penalties of up to $3,000.00 apply for failing to submit an incident report when required.
